Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and xBenefits LLC, an Indiana limited liability company located at 700 E Firmin Street, Kokomo, IN 46901 ("xBenefits," "we," "our," or "us"). By accessing or using this website and any related services (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

The Service is an informational and intake platform that helps U.S. importers determine potential eligibility for refunds of tariffs paid under International Emergency Economic Powers Act ("IEEPA") orders. Qualified inquiries are referred to an independent law firm.

xBenefits LLC is a technology company. It is not a law firm, does not provide legal advice, and does not represent you in any legal matter.Any attorney-client relationship is formed solely between you and the independent law firm if and when you execute a separate written engagement with that firm.

Information on the Service is provided for general informational purposes only and does not constitute legal, tax, financial, or professional advice. We make no representation or warranty regarding the outcome of any legal claim, eligibility for any refund, or the amount that may be recovered. Past results do not guarantee future outcomes.

You must be at least 18 years old and authorized to act on behalf of any business you represent. By submitting information, you represent that the information you provide is accurate and that you have authority to provide it.

You agree that information you submit (including business details, importing activity, and contact information) may be shared with the partner law firm and with sub-affiliates or referral partners involved in your introduction. We handle this information consistent with our Privacy Policy.

The Service, including all software, design, text, graphics, logos, and the underlying intake and attribution technology, is owned by xBenefits LLC and is protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access the Service for your own internal evaluation. You may not copy, modify, reverse engineer, scrape, frame, mirror, or create derivative works of the Service or its underlying technology without our prior written consent.

You agree not to:

• Submit false, misleading, or fraudulent information;
• Use the Service to violate any law or regulation;
• Interfere with the security or operation of the Service;
• Use automated means to access the Service without our written consent; or
• Resell, sublicense, or commercially exploit the Service or any data obtained from it.

The Service relies on third-party providers (including hosting, analytics, and communications providers) and refers qualified leads to an independent law firm. We are not responsible for the acts, omissions, services, or content of any third party, including the law firm.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. xBenefits LLC DOES NOT WARRANT THAT YOU WILL QUALIFY FOR ANY REFUND OR THAT ANY PARTICULAR LEGAL OUTCOME WILL OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, xBenefits LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify, defend, and hold harmless xBenefits LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your information submissions, or your violation of these Terms.

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Howard County, Indiana, and you consent to personal jurisdiction there.

We may update these Terms from time to time. The "Last updated" date above indicates when changes were last made. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
